Privacy is a fundamental right and Catalysk Innovations Private Limited (Catalysk/Us/We/Our), treats it as such. As part of Your use of the Services, We may collect and process Your data including personally identifiable data. We are committed to protecting the privacy and security of the personal data belonging to and/or shared by the users of the Platform including but not limited to the customers (User/You/Yourself/Your). This privacy policy (Privacy Policy) provides how Your data is collected, used, shared and the manner in which We protect Your data upon Your use of the website https://catalysk.com (Platform) and Our other Services. 

 

CONSENT

  1. This Privacy Policy as available and uploaded on the Platform, or any other specific terms and conditions, as applicable or relating to the use of Our Platform, products, services, applications or other facilities or mediums (Services), shall constitute a legally binding agreement between You and Us in connection with Your access, usage, visit or use of Our Services in any manner. We request You to carefully read this Privacy Policy before You access the Platform or use Our Services. By visiting and/or accessing the Platform (or searching for any of the pages on Our Platform) or by otherwise giving Us Your information, You will be deemed to have read, understood, and agreed to the practices and policies outlined in this Privacy Policy and agreed to be bound by this Privacy Policy.

  2. Collection, use and disclosure of information which has been designated as ‘Personal Information’ under Information Technology (Reasonable Security Practices and Procedures and Sensitive Personal Data Or Information) Rules, 2011 or under the Digital Personal Data Protection Act, 2023 (DPDP Act) requires Your express consent. By affirming Your assent to this Privacy Policy, You provide Your free, specific, informed, unconditional and unambiguous consent to such use, collection and disclosure, as required under applicable law.

WHAT INFORMATION OF YOURS IS COLLECTED

  1. You will not be able to access Our Platform without You providing consent to this Privacy Policy. If You do not agree with the Privacy Policy or do not fully understand the terms therein, please do not use Our Services and/or provide Us Your information. By affirming Your assent to this Privacy Policy, You provide Your free, specific, informed, unconditional and unambiguous consent to such use, collection and disclosure of Your Personal Information in accordance with this Privacy Policy. 

  2. While accessing and/or using Our Services, We may obtain (from You or Your employer, if You are availing Our Services through Your employer) or ask You to provide Us with certain information. The information sought may be personally identifiable information that can be used to contact or identify You or could be used to personally identify You (Personal Information).

  3. Before creating an account with Us, We collect Your email address (either directly through You or Your employer through whom You are availing Our Services).

  4. Upon creation of an account with Us, We may collect various types of information from You, including but not limited to the following information: (a) salutation, first name and last name; (b) email address; (c) Zip code; and (d) information relating to Your residence, family members, energy/resource consumption. 

  5. When You make purchases on Our brand partners' websites, We collect: (a) the details on the items purchased and (b) purchase amount. 

  6. We may also collect information that You post in Your feedback, reviews, comments etc. on the Platform.

  7. You understand and agree that when You visit the Platform, We automatically receive the URL of the site from which You visit. We also receive the computer operating system and type of web browser, email patterns, device details, as well as the name of Your internet service provider. This information is used to analyse overall trends, understand user behaviour and to help Us improve Our Service.

  8. We understand that the Personal Information is private to You and assure You that it will be used by Us only for providing Services in such manner as stated under this Privacy Policy.

  9. You agree and undertake that all information provided by You to Us shall be complete, accurate, consistent and verifiable. We shall assume the legitimacy, accuracy and completeness of all information, to the extent they are provided to Us or caused to be provided to Us by You. We shall not be liable for any liability pertaining to the authenticity/ genuineness/ misrepresentation/ fraud/ negligence, etc. of the information disclosed to Us and We shall not be obliged, in any way, to verify any information obtained from You.

 

HOW WE COLLECT YOUR INFORMATION?

  1. The data that We collect are only for legitimate purposes and as required to provide Our Services and for Us to better understand Your interests. We may collect information through various means including but not limited to the following:

    • While You sign up, subscribe, create a profile on the Platform;

    • When You access, interact, use, or avail any of Our Services, or make any purchases on Our brand partners' websites;

    • When you provide Us Your information through any external mediums such as phone calls, virtual or in person meetings, forms, links, emails, Whatsapp or other messaging platforms, other forms of digital or physical communication, or in any other manner; and/or

    • By use of cookies as detailed in Clause -Use of Cookies.

  2. ​Public Information: We may also collect Personal Information about You from: 

    • any publicly available sources where You have published or made available any information about You, including but not limited to on any social media platforms; and

    • data made available to the public by any person under an obligation imposed on them by any statutory, regulatory or government authority to make such personal information publicly available.

    • Notwithstanding anything stated elsewhere in this Privacy Policy, the information collected under this Clause  -Public Information shall not be bound by any of the terms provided in this Privacy Policy. However, if You make a request to update or correct any information so collected by Us, the provisions of this Privacy Policy shall apply to such information only to the extent so updated or corrected.

  3. We may use third-party service providers to perform data analytics on Our behalf across the internet and sometimes on this Platform. They may collect anonymous information about Your visits to Our Platform and Your interaction with Our Services. We do not provide them access to any personally identifiable information, unless You provide consent for the same.

  4. We may use the services of third-party analytics tools or products and We may share Your Personal Information to such third parties as required. Further, such third-party services may collect Your information on Your interaction with the Platform as well. Notwithstanding the above, We may share and/or disclose some of the aggregate findings (not the specific data) in order to help Us provide better Services to You. 

  5. We may obtain information about You from other sources, including through third party services and organizations, to supplement information provided by You. For example, if You access the Platform through a third-party application, such as an app store, a third-party login service, or a social networking site, We may collect information about You from that third-party application that You have made public via Your privacy settings.

  6. We do not trade or sell Your Personal Information in any manner, without taking specific consent from You. 

  7. Access to Our Services may require payment. The payments for the Services are done through third party payment services. We do not store or process any of Your financial information such as bank accounts, credit and debit card details or other payment instrument details except for Your UPI ID in the event You make a UPI transaction with Us.

 

HOW YOUR INFORMATION WILL BE USED?

  1. We collect and use Your Information for legitimate purposes such as:

    • for developing new products;

    • for generating a sustainability score or any other metric;

    • for displaying in Your organisation or community’s leader boards and at in-person events that You choose to register for or attend;

    • for enabling communication between You and Us (which includes any third-party service providers or vendors that We have authorised for this purpose) as may be required for the performance of the Services, by any modes of communication, including but not limited to emails, phone calls, letters, notifications, text, Whatsapp or other forms of messages;

    • to provide You with information about the Services available on the Platform;

    • to personalize Your experience on the Platform;for research, statistical analysis and business intelligence purposes in an aggregated or non-personally identifiable form or otherwise;

    • to enable any of Our vendors or service providers to provide their services to Us, in relation to the implementation of the Services.for obtaining feedback in relation to the Services;

    • to address customer support related issues;for proper administration of the Platform;

    • to conduct internal reviews and data analysis for the Platform (e.g., to determine the number of visitors to specific pages within the Platform) and prepare internal reports, registers and records as may be required for the functioning of the Platform;

    • to improve the Services, content and advertising on the Platform;

    • for the purpose of making advertisements, promotions or conducting any promotional activities in relation to the Services;

    • to protect the integrity of the Platform;

    • to protect and defend the rights or property of Catalysk;

    • to make disclosures as may be required under applicable laws, rules, regulations, orders, notices or to respond to judicial process and provide information to law enforcement agencies, judicial and quasi-judicial authorities;  and 

    • for all purposes as may be required for the effective performance of the Services including those specified in Clause - Sharing YourInformation with your Organisation 

  2. You acknowledge that the information that You have provided to Us is intended to be used for the effective performance of the Services and that We intend to share such information on the Platform to Our vendors and service providers, and such other persons that may be required to receive such information in furtherance of or for the performance of the Services. 

  3. In certain circumstances, We may anonymize Your Personal Information (so that it can no longer be associated with You) for research or statistical purposes and such anonymized data will cease to be Your Personal Information.

  4. By consenting to this Privacy Policy, You provide Us with the consent to process and use Your data in the manner provided under this Privacy Policy until such time that You continue to avail Our Services.

 

SHARING OF YOUR INFORMATION

  1. Without prejudice to any other provisions of this Privacy Policy, We may also transfer or disclose Your information as provided under:

    • to Our associates, vendors, service provider and affiliates to help detect and prevent fraud, identity theft and other illegal activities, correlate related or multiple accounts to prevent abuse of Our Services;

    • to Our affiliates, employees, associates, vendors or service providers, for the purpose of enabling Us to provide the necessary Services; and

    • to Our associates or affiliates should We decide to undergo restructuring in anyway or is acquired by any other entity.

  2. We will obtain Your specific consent in the event We are required to transfer or disclose Your Personal Information in any manner other than as provided in this Privacy Policy.

SHARING YOUR INFORMATION WITH YOUR ORGANISATION

  1. In the event, You are availing Our Services and Your organisation has subscribed to Our Services, We shall, upon verification of Your corporate e-mail ID, provide Your organisation with limited access to Your information. You may review the details shared with Your organisation through the Platform or You may write to Us at the e-mail ID provided in Annexure A below.

  2. In the event You have registered with/provided your corporate e-mail ID for availing Our services and (a) You have registered or signed up for a campaign, (b) You are on a particular leaderboard, or (c) You are eligible for employee benefits, We shall share with Your organisation any such information necessary to identify You. 

  3. We may, in addition to the above, share aggregated information with Your organisation of all Users who are employed at Your organization including without limitation, data relating to the User’s consumption patterns, rewards, recognition, total potential savings, total achieved savings (both verified and unverified) and leaderboard scores with Your organisation. 

  4. In the event the engagement between You and Your organisation ends or You request Us to stop sharing Your Data with Your organisation, We shall cease sharing Your ongoing activities information with Your organisation within 30 (thirty) days from Us receiving such intimation from the organisation or You, whichever is earlier. In the event you request Us to stop sharing Your Data with Your organisation, You may not be able to access all or part of Our Services from thereon and/or We shall intimate Your organisation that You have withdrawn Your consent to share Your information with Your organisation. 

 

YOUR RIGHTS RELATED TO YOUR PERSONAL INFORMATION

  1. If We have collected any Personal Information from You, You may make a request to exercise the following rights:

    • right to withdraw Your consent at any time where We rely on Your consent to process Your Personal Information; 

    • right to have Your information rectified or updated if such information is found to be incomplete or inaccurate;

    • right to object to Us processing data collected from You;

    • right to request that We restrict the processing of Your Personal Information;

    • right to be notified in the event of a breach of any Personal Information collected by the Platform;

    • right to be provided information on the processors or other entities who We have provided access to Your Personal Information along with the description of the data so shared;

    • right to access modify and right to request deletion of information that We have on You subject to data retention requirement under applicable laws; 

    • right to be provided with a copy of Your Personal Information processed by Us and the processing activities undertaken by Us with respect to Your Personal Information; and

    • right to request Us to erase Your Personal Information.

  2. If You have exercised any of Your rights under (a), (c) and (d), You may not be able to use Our Services, and/or You may not be allowed to access any or all of the features/parts of the Platform. 

  3. You shall also have the option to not provide information by choosing not to use the Services or a particular feature thereof (where such feature is available for opt-out). We may automatically use Our available technology to retain Your preferences. 

  4. If You do not want to receive updates from Us, please update Your preferences or write to Us at the email ID provided in Annexure A below. However, opting out of updates may affect Your use of the Platform.

  5. When You update Your information available with Us, We may keep a copy of all previous versions for Our records.

  6. If You would like to exercise any of the rights mentioned above, You may write to Us at the e-mail IDs provided in Annexure A below. 

  7. If You need to appoint a nominee to act on behalf of You in the event of Your death or incapacitation, You may inform Us of such appointment by writing to Us in the e-mail ID provided in Appendix A.

 

DATA RETENTION

  1. Within 30 (thirty) days of permanent deletion of Your account, We will delete all Personal Information associated with Your account unless retention of the same is necessary for compliance with any law for the time being in force. You acknowledge and understand that, due to the nature of the Services that We provide, We may be required to keep records or registers of the information You provide to Us to maintain the quality and integrity of the Services provided or as may be required under applicable law. We will only retain Your Personal Information for as long as may be necessary for the performance of the Services and for the effective and safe functioning of the Platform, including for the purposes of satisfying any legal, accounting, or reporting requirements under applicable laws

  2. In the event that You choose to withdraw Your consent to the collection and/or processing of Your data, We shall erase and cease processing of any personally identifiable information that We have collected from You within such number of days from the date of withdrawal of consent as may be prescribed under applicable law for such erasure. However, We reserve the right to retain such data as may be required to be retained by Us for compliance with any applicable law.

  3. It is clarified that the rights that You may have under this Clause - Data Retention, shall only be applicable and made effective from 30 (thirty) days from the date of receipt of request for the exercise of such right and shall not retrospectively apply to any consents, approvals or processing of information that has already taken place prior to such date.

 

TRANSFER OF YOUR PERSONAL INFORMATION

  1. Your Personal Information is processed at Our operating offices or such other places where We store the data including in cloud storage . It means that this information may be, subject to applicable laws, transferred to and maintained on computers located outside of Your state, province, country or other governmental jurisdiction where the data protection laws may be different to those from Your jurisdiction. We encrypt all Personal Information in rest and transit.

  2. Your consent to this Privacy Policy followed by Your submission of such information represents Your agreement to that transfer.

 

AUTHORIZED THIRD PARTY ACTIVITIES

  1. Links to third-party websites or any third-party electronic communication service may be provided on the Platform which are operated by third parties and are not engaged by, controlled by, affiliated to, or associated with Us. The existence of these links does not in any way imply that We endorse the linked website, the providers of the website or the information included in such links. Your interaction with any such linked website is entirely at Your own risk. We do not make any representations concerning the privacy practices or policies of such third parties or terms of use of such third-party websites, nor do We control or guarantee the accuracy, integrity, or quality of the information, data, text, software, music, sound, photographs, graphics, videos, messages or other materials available on such third-party websites. Your use of a linked website and the information provided by You to such third-party websites are subject to the terms and conditions and privacy policies of that site. We may receive payments or commission from Our association with these third-party websites. Notwithstanding any relationship we have with such third-party websites, We cannot be in any manner considered to be a party to any transactions You make on such linked website and We are not responsible for any transactions or interactions therein. It is recommended that You review the privacy policy of such third-party websites prior to using such websites. 

  2. We may share Personal Information, including stored cookies with entities that provide services to Us, including companies that provide web analytics, storage, email distribution and other services. The use of Personal Information by such companies is limited to the purpose of rendering the contracted services.

 

YOUR DUTIES AND OBLIGATIONS

  1. You shall, while providing Us information or exercising any rights provided under this Privacy Policy or the DPDP Act: 

    • comply with the provisions of all applicable laws for the time being in force while exercising rights under this Privacy Policy or the provisions of DPDP Act;

    • ensure not to impersonate another person while providing Your data;

    • to ensure not to register a false or frivolous grievance or complaint with Us, Our grievance redressal system or any other authority; and 

    • ensure to furnish only such information as is verifiably authentic, while providing Us Your data and while exercising the right to correction or erasure of Your information.

  2. ​Any information that You provide to Us or consent to Us collecting, We shall assume that You are in compliance with Your duties and obligations as provided under this Clause and the accuracy, completeness and authenticity of the information so collected.

 

OUR SECURITY PRACTICES AND PROCEDURES

  1. We take security measures to protect Your information submitted through Our Platform. When information is required to create an account, that information is encrypted and secured upon its provision. This can be verified by looking for a lock icon in the address bar and seeing "https" at the beginning of the address of the web page. The security of Your Personal Information is important to Us. We adopt reasonable security practices and procedures to include, technical, operational, managerial, and physical security control measures in order to protect all User information including Personal Information in Our possession from loss, misuse and unauthorized access, disclosure, alteration, and destruction. We follow generally accepted industry standards to protect the Personal Information submitted to Us, both during transmission and once We receive it. However, no method of transmission over the internet, or method of electronic usage, is hundred percent secure. Therefore, We cannot guarantee its absolute security.

  2. Therefore, You acknowledge and agree that We assume no liability regarding the theft, loss, alteration, or misuse of personal or other information or content, including, without limitation, such information that has been provided to third parties or other Users, or with regards to the failure of a third party to abide by the agreement between Us and such third party. You also play an important role in keeping Your Personal Information secure. You should not share Your username, password, or other security information for Your Platform account with anyone. If We receive instructions using Your username and password, We will consider that You have authorized the instructions. In the unlikely event that We come to learn that either Our system or Your account specifically has suffered a security breach, We may attempt to notify You electronically so that You can take appropriate protective steps, by e-mail, text message, phone call, a notice on Our Platform, or any other way, depending upon the requirements of the applicable law.

  3. We also protect Your Personal Information offline, as only employees who require access to Your Personal Information to perform a specific job are granted access. Additionally, the servers which We use to store Your information are kept in a secure environment.

 

USE OF COOKIES

  1. Cookies are text files placed on Your computer to collect standard internet log information and visitor behaviour information. When You visit Our Platform, We may collect information from You automatically through cookies or similar technology.

  2. We use "cookies" on Our Platform to help to improve Your access and experience when using Our Platform. For example, cookies allow Us to identify You when visiting Our Platform so that You do not need to use Your password multiple times over various website sessions. Cookies also allow Us to provide You with a better experience on Our site by allowing Us to better understand the interests of Our Users. Cookies are not linked to personally identifiable information on Our Platform.

  3. We only place necessary cookies on Your Computer and do not place any marketing or optional cookies. 

  4. You may set Your browser to not accept cookies. However, in a few cases, some of Our Platform features may not function optimally as a result.

 

GRIEVANCES

  1. We strive to redress Your concerns expeditiously. In the event that You have a grievance, You may report the concern to the grievance officer who shall redress the grievances within 30 (thirty) days from date of receipt of such grievance. Please find the details of the grievance officer in Appendix A.

  2. Individual Users may review any Personal Information concerning themselves that We have with Us by contacting Our grievance officer at the address provided in the Appendix A. 

 

CHANGES TO THIS PRIVACY POLICY

  1. We reserve the right to update or change Our Privacy Policy at any time and You should check this Privacy Policy periodically. Your continued use of the Service after We post any modifications to the Privacy Policy on this page will constitute Your acknowledgment of the modifications and Your consent to abide and be bound by the modified Privacy Policy. We shall not be liable for any failure or negligence on Your part to review the updated Privacy Policy before accessing or using the Platform.

  2. If We make any material changes to this Privacy Policy, We will notify You either through the email address You have provided to Us, or by placing a prominent notice on the Platform.

 

DISPUTE RESOLUTION AND BINDING ARBITRATION

Any action, dispute or difference arising under or relating to this Privacy Policy shall at the first instance be resolved through negotiations in good faith between the disputing parties thereto, which negotiations shall begin promptly, within 15 (fifteen) days after a party has delivered to the other party a written request for such consultation. If the parties are unable to resolve the dispute in question within 15 (fifteen) days of the commencement of negotiations, such dispute shall be referred to and finally resolved by arbitration by a sole arbitrator jointly appointed by the disputing parties in accordance with the Arbitration and Conciliation Act, 1996, as amended from time to time and rules prescribed thereunder. The place and seat of arbitration shall be Bangalore, India and the language shall be English.
